Sec. 1. Medicaid buy-in for persons with disabilities. Resolved: That by January
1, 2004, the Department of Human Services shall amend the
rules regarding eligibility for employed persons with
disabilities and their spouses to purchase coverage under the
Medicaid program. The amended rules must maintain the income
eligibility limit of 250% of the federal nonfarm income
official poverty level for earned and unearned income combined
and must remove any separate limitation on unearned income.
Rules adopted pursuant to this section are routine technical
rules as defined by the Maine Revised Statutes, Title 5,
chapter 375, subchapter 2-A.

 
SUMMARY

 
This resolve requires the Department of Human Services to
amend the rules to allow persons with disabilities and their
spouses to purchase coverage in the Medicaid program. The
rules must maintain income eligibility limits while removing
separate limits on earned and unearned income.
