Sec. 1. 38 MRSA §438-A, sub-§1-C is enacted to read:

1-C.__Guidelines for public trails within railroad rights- of-way.__The guidelines may not prohibit thinning and pruning of vegetation within railroad rights-of-way.

Sec. 2. 38 MRSA §439-A, sub-§6-A is enacted to read:

6-A.__Railroad rights-of-way.__Notwithstanding the provisions of subsection 6, a municipal ordinance may not prohibit, within the shoreland zone, thinning and pruning of vegetation within railroad rights-of-way.

SUMMARY

This bill amends the shoreland zoning ordinance guidelines to allow thinning and pruning of vegetation within railroad rights-of-way.
