Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 5 MRSA §12004-I, sub-§3-B is enacted to read:

Sec. 2. 12 MRSA §1893-B is enacted to read:

 
§1893-B.__Advisory council established

 
1.__Appointment and composition.__The Snowmobile Trail Fund
Advisory Council, referred to in this section as "the advisory
council" and established by Title 5, section 12004-I,
subsection 3-B, consists of 9 members.__The director or the
director's designee serves as an ex officio member and may
vote only to break a tie.__The other 8 members are appointed
by the commissioner as follows:

 
A.__Three members who represent snowmobile clubs that are
Snowmobile Trail Fund grantees;

 
B.__Three members who represent municipal Snowmobile Trail
Fund grantees; and

 
C.__Two members who represent a statewide organization
with an interest in snowmobiling.

 
2.__Terms.__Members of the advisory council serve for 3
years and continue serving until a successor is duly appointed
and qualified.__A member may not serve more than 2 consecutive
3-year terms.__When a vacancy__occurs, the commissioner shall
fill the vacancy by appointing a member from the same category
as the member who vacated the advisory council and that member
continues to serve for the remainder of the term.__An employee
of the department may not serve as a member of the advisory
council prior to the expiration of one year from the
employee's last day of employment with the department.__A
legislator may not serve as a member of the advisory council.

 
3.__Compensation.__Advisory council members are entitled to
expenses and legislative per diem as provided in Title__5,
chapter 379.
