Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 29-A MRSA §2115 is enacted to read:

 
§2115.__Distracted driving

 
1.__Distracted driving.__A person is guilty of distracted
driving if the person operates a motor vehicle while,
including, but not limited to, using a cellular telephone,
eating, reading or grooming.

 
2.__Enforcement.__Subsection 1 may be enforced only if a law
enforcement officer has detained the operator of a motor
vehicle for a suspected violation of another law.

 
SUMMARY

 
This bill prohibits a person from driving while distracted.
Driving while distracted is, including, but not limited to,
driving while using a cellular telephone, eating, reading or
grooming. Under the provisions of the bill, a law enforcement
officer may enforce this prohibiton only if the officer has
detained the operator of the motor vehicle for a violation of
another law.
