Sec. 1. 38 MRSA §1864, as enacted by PL 2001, c. 434, Pt. A, §7, is amended by adding at the end a new paragraph to read:

Prior to the application of a herbicide to a water body in the State, the commissioner shall hold at least one public hearing in a municipality bordering the water body.__The public hearing held pursuant to this paragraph must be held no earlier than 30 days and no later than 15 days prior to the application.__The commissioner shall present all information relative to the application at the public hearing held pursuant to this paragraph.

SUMMARY

This bill requires a public hearing prior to the application of a herbicide to a body of water in the State. The public hearing must be held in a municipality bordering the body of water no earlier than 30 days and no later than 15 days prior to the application, and all information relative to the application must be presented at the hearing.
