| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 20-A MRSA §4010 is enacted to read: |

| | | §4010.__Pornography restrictions |
|
| | | An elementary or secondary school in the State may not allow | | a person under 18 years of age to access obscene, pornographic | | or other material that may be harmful to a person under 18 | | years of age through the use of a computer or computer server | | of that school. |

| | | Sec. 2. Rules. The Department of Education shall adopt rules to | | carry out the purposes of this Act. Rules adopted pursuant | | to this section are major substantive rules as defined in the | | Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A. |

| | | This bill prohibits an elementary or secondary school from | | allowing a person under 18 years of age to access obscene or | | pornographic materials through the use of that school's | | computer. This bill directs the Department of Education to | | adopt rules to implement this bill. |
