violation or to enforce this subchapter, including requiring the | | employer to pay to the employee as liquidated damages, including | | interest, the greatest of: |

| | | A.__One hundred dollars for each day the violation | | continues; |
|
| | | B.__Actual wages, salary, benefits, employment benefits or | | other compensation denied or lost to the employee as a | | result of the violation; and |
|
| | | C.__If there was no loss under paragraph B, the actual | | monetary losses sustained by the employee as a direct | | result of the violation, such as the cost of providing | | care, up to a sum equal to 12 weeks of wages or salary for | | the employee. |
|
| | | 3.__Fees and costs.__The court may order the employer to pay | | reasonable attorney's fees, reasonable expert witness fees and | | other costs of the action. |

| | | This bill amends the family medical leave requirements to | | reflect the requirements of the federal Family and Medical | | Leave Act of 1993 by: |
|
| | | 1. Extending the family medical leave entitlement to 12 | | weeks from 10 weeks; and |
|
| | | 2. Allowing the court to award liquidated damages equal to | | actual wages lost by the employee or costs paid by the | | employee due to the violation. The court also may award | | reasonable attorney's and expert witness fees as well as court | | costs. |
