| | | 2.__Nonviolation.__Provide that a telemarketing call made to | | a number on the Maine do-not-call list is not a violation of | | section 14756 if the telemarketing call is an isolated | | occurrence made by a person who has in place adequate | | procedures to comply with this subchapter; and |

| | | 3.__Format of list; fee.__Provide for: |

| | | A.__The dissemination of copies of the Maine do-not-call | | list in formats, including electronic formats, commonly | | used by persons making telemarketing calls; and |
|
| | | B.__A fee, not to exceed $75, for each distribution of the | | Maine do-not-call list. |

| | | §14759.__Report by Attorney General |
|
| | | Before December 31st of each even-numbered year, the | | Attorney General shall submit a report to the Legislature.__ | | The report must contain for the 2-year period ending August | | 31st of the year of the report: |

| | | 1.__Maine do-not-call list statistics.__A statement of the | | number of telephone numbers included on the Maine do-not-call | | list, the number of copies of the Maine do-not-call list | | distributed and the amount collected for those requests and | | for distribution; |
|
| | | 2.__Complaints.__A list of complaints received by the | | Attorney General or a state agency concerning activities | | regulated by this subchapter, itemized by type; |
|
| | | 3.__Enforcement.__A summary of any enforcement efforts made | | by the Attorney General and any state agencies; and |
|
| | | 4.__Recommendations.__The Attorney General's recommendations | | for any changes in this subchapter and any necessary | | implementing legislation. |
|
| | | Emergency clause. In view of the emergency cited in the | | preamble, this Act takes effect when approved. |

| | | This bill regulates telephone solicitation by consolidating | | various laws regarding telemarketers found in different | | sections of the Maine Revised Statutes and does the following. |
