Sec. 1. 5 MRSA §18001-A is enacted to read:

§18001-A.__Presumption regarding death of law enforcement officer

A member is presumed to have died as a result of an injury arising out of and in the course of employment as an employee if:

1.__Law enforcement officer.__The member at the time of death was a law enforcement officer, as defined in Title 25, section 1611, subsection 5;

2.__Hypertension or heart disease.__The member died as a result of a condition or impairment caused by hypertension or heart disease; and

3.__Prior physical examination.__The member, at the time of becoming a law enforcement officer, or at any time thereafter, had undergone a physical examination that failed to reveal evidence of a condition or impairment caused by hypertension or heart disease.

Sec. 2. 5 MRSA §18601-A is enacted to read:

§18601-A.__Presumption regarding death of law enforcement officer

A member is presumed to have died as a result of an injury arising out of and in the course of employment as an employee if:

SUMMARY

This bill provides that, for purposes of determining whether beneficiaries of a law enforcement officer are entitled to the accidental death benefit provided by the Maine State Retirement
