4.__Hearing process.__The municipal officers or, in the case of an unincorporated place, the county commissioners of the county in which the unincorporated place is located may hold a public hearing for the consideration of the applications for new video gaming terminal licenses.__The municipal officers or county commissioners may hold a public hearing for the consideration of requests for renewal of licenses.

A.__The Chief of the State Police shall prepare and supply license application forms.

B.__The municipal officers or the county commissioners shall provide, at the applicant's prepaid expense, public notice of a hearing held under this section by causing a notice stating the time and place of hearing to appear at least 6 consecutive days before the date of the hearing in a daily newspaper having general circulation in the municipality or unincorporated place where the premises are located or 2 consecutive weeks before the date of the hearing in a weekly newspaper having general circulation in the municipality or unincorporated place where the premises are located.

C.__In granting or denying an application, the municipal officers or the county commissioners shall indicate the reasons for their decision and provide a written statement of their reasons to the applicant.

§372.__Placement and ownership of terminals

1. Number of terminals;__location.__No more than 5 video gaming terminals may be placed on the premises of a licensee. A terminal may not be placed in any location other than the premises of the licensee.__A licensee must own or control the premises on which a video gaming terminal is located.__The terminal area must be designed to permit the licensee or an agent of the licensee to see and control the area at all times to ensure compliance with the provisions of this chapter.

2.__Uniform location application.__Each location must be subject to an approved uniform location application.__A copy of the application must be submitted to the Chief of the State
