§394.__Violations

1.__Crimes by licensees.__A licensee under this chapter commits a Class D crime when that licensee:

A.__Knowingly permits a person under 21 years of age to play a video lottery terminal; or

B.__Knowingly permits a person to play a video lottery terminal at a time other than during the hours for which play is permitted under section 381.

2.__Class C crimes by any person.__A person commits a Class C crime if that person:

A.__Tampers with a video lottery terminal with intent to interfere with the proper operation of that terminal;

B.__Manipulates or intends to manipulate the outcome, payback or operation of a video lottery terminal by physical tampering or any other means;

C.__Manufactures, distributes, sells, operates or places a video lottery terminal for use in this State without a license; and

D.__Places for public use or operates an unlicensed video lottery terminal in this State.

§395.__Fines, suspensions and revocations

To enforce the provisions of this chapter and the rules referred to in section 364, subsection 1, paragraph C, the commission is authorized to establish a schedule of fines not to exceed $1,000 for each violation of this chapter or each violation of the rules.__The commission is authorized to levy a fine, after notice and hearing, for each violation of this chapter or each violation of the rules.

The commission is authorized to establish a schedule of suspensions of licenses and may levy suspensions for each violation of this chapter or the rules adopted pursuant to this chapter.
