| | 5.__Inspections.__The board may contract with municipalities | or with qualified private building inspectors to enforce the | building code established in this section. |

| A.__Contracts between the board and private inspectors or | municipalities must include terms that: |
|
| (1)__Prohibit conflicts of interest; |
|
| (2)__Specify the scope of work to be performed; |
|
| (3)__Provide, at a minimum, for the inspection of the | foundation, frame and completed structure; |
|
| (4)__Specify terms and schedule of payment; |
|
| (5)__Designate means of resolving disputes arising | under the contracts; and |
|
| (6)__Allocate liability for nonperformance of | contractual obligations. |
|
| B.__As soon as possible after each inspection of a dwelling, | the board shall provide a written notice of approval of the | portion of the construction as completed or shall specify | any deficiency or failure to comply with the applicable | code. |

| §15359.__Required contract provisions |
|
| | A home construction or home improvement contract is not valid | or enforceable against an owner unless it: |
|
| | 1.__Compliance.__Is in compliance with Title 10, chapter 219- | A; |
|
| | 2.__Writing.__Is in writing and legible; |
|
| | 3.__Signed.__Is signed by the owner and the home contractor or | a home contractor salesperson on behalf of a home contractor; |
|
| | 4.__Entire agreement.__Contains the entire agreement between | the owner and home contractor; |
|
| | 5.__Transaction date.__Contains the date of the transaction; |
|
| | 6.__Contractor data.__Contains the name, street address and | the license number of the home contractor; |
