With the advice of the Commissioner of Transportation and the
Chief of the State Police, the Secretary of State shall establish
rules for the operation of pilot vehicles.

 
Sec. R-75. 29-A MRSA §2396, sub-§1, as enacted by PL 1993, c. 683, Pt.
A, §2 and affected by Pt. B, §5, is amended to read:

 
1. Injurious substances. A person may not place on a way a
tack, nail, wire, scrap metal, glass, crockery or other substance
that may injure feet, tires or wheels. If a person accidentally
places such substance on a way, that person shall immediately
make all reasonable efforts to clear the way of that substance.

 
Sec. R-76. 29-A MRSA §2396, sub-§1-A is enacted to read:

 
1-A.__Duty to clear way.__If a person accidentally places an
injurious substance on a way, that person shall immediately make
all reasonable efforts to clear the way of that substance.

 
Sec. R-77. 29-A MRSA §2411, sub-§1, as amended by PL 1995, c. 368, Pt.
AAA, §7, is repealed.

 
Sec. R-78. 29-A MRSA §2411, sub-§1-A is enacted to read:

 
1-A.__Offense.__A person commits OUI if that person:

 
A.__Operates a motor vehicle:

 
(1)__While under the influence of intoxicants; or

 
(2)__While having a blood-alcohol level of 0.08% or
more;

 
B.__Violates paragraph A and:

 
(1)__Has one previous OUI offense within a 10-year
period;

 
(2)__Has 2 previous OUI offenses within a 10-year
period; or

 
(3)__Has 3 or more previous OUI offenses within a 10-
year period;

 
C.__Violates paragraph A, failed to submit to a test at the
request of a law enforcement officer and:

 
(1)__Has no previous OUI offenses within a 10-year
period;
