| | | 20.__Abuse of another person's property.__A person may not | | while operating a snowmobile: |
|
| | | A.__Tear down or destroy a fence or wall on another person's | | land; |
|
| | | B.__Leave open a gate or bar on another person's land; or |
|
| | | C.__Trample or destroy crops on another person's land. |
|
| | | A person who violates this subsection commits a Class E crime. |
|
| | | 21.__Unlawfully permitting operation.__A person who owns a | | snowmobile may not knowingly permit the snowmobile to be operated | | in violation of any section of this chapter. |
|
| | | A person who violates this subsection commits a civil violation | | or which a forfeiture of not less than $100 nor more than $500 | | may be adjudged. |
|
| | | 22.__Failure to report accident.__A person shall give notice | | of a snowmobile accident, by the quickest means of communication, | | to a law enforcement officer available nearest to the place where | | the accident occurred if that person is: |
|
| | | A.__The operator of a snowmobile involved in an accident | | resulting in injuries requiring the services of a physician | | or in the death of a person; |
|
| | | B.__A person acting for the operator of a snowmobile | | described in paragraph A; or |
|
| | | C.__The owner of the snowmobile having knowledge of the | | accident, if the operator of the snowmobile is unknown. |
|
| | | Accidents involving only property damage to the estimated amount | | of $1,000 or more must be reported within 72 hours on forms | | provided by the department. |
|
| | | A person who fails to comply with this subsection commits a civil | | violation for which a forfeiture of not less than $100 nor more | | than $500 may be adjudged. |
|
| | | 23.__Operating snowmobile on open water.__A person may not | | operate or attempt to operate a snowmobile on open water.__For | | purposes of this subsection, "open water" means any area of an | | inland water body that is free of ice and snow.__This subsection | | does not apply to private ponds. |
