9.__Other health promotion; disease prevention.__Other health
promotion and disease prevention activities included in a state
health plan.

 
Each fiscal year, the State Controller is authorized to
provide an annual advance from the General Fund to the Fund for a
Healthy Maine, or its successor, to provide money for allocations
from the fund.__This money must be returned to the General Fund
as the first priority from the amounts credited to the fund.

 
Any unencumbered balance remaining at the end of any fiscal
year lapses back to the Fund for a Healthy Maine account, or its
successor, within the Department of Administrative and Financial
Services and may not be made available for expenditure without
specific legislative approval.

 
It is the intent of the people of Maine that the Fund for a
Healthy Maine be used to fund services and programs at a level
above the level of funding that existed at the time the Fund for
a Healthy Maine was created and that tobacco settlement money not
be used, directly or indirectly, to supplant current levels of
funding for other programs and services.

Constitutional referendum procedure; form of question; effective date. Resolved:
That the municipal officers of this State shall notify the
inhabitants of their respective cities, towns and plantations to
meet, in the manner prescribed by law for holding a statewide
election, at a statewide election, on the Tuesday following the
first Monday of November following the passage of this
resolution, to vote upon the ratification of the amendment
proposed in this resolution by voting upon the following
question:

 
"Do you favor amending the Constitution of Maine to require
that Maine's tobacco settlement money be used only for
health-related purposes, including prevention and treatment
of disease and addiction and access to health care for both
children and adults?"

 
The legal voters of each city, town and plantation shall vote
by ballot on this question and designate their choice by a cross
or check mark placed within the corresponding square below the
word "Yes" or "No." The ballots must be received, sorted,
counted and declared in open ward, town and plantation meetings
and returns made to the Secretary of State in the same manner as
votes for members of the Legislature. The Governor shall review
