Sec. 1. 22 MRSA c. 262-A, sub-c. 4 is enacted to read:

SUBCHAPTER 4

NICOTINE PRODUCTS

§1560.__Sales of nicotine water products

1.__Definitions.__As used in this subchapter, unless the context otherwise indicates, the following terms have the following meanings.

A.__"Nicotine water" means bottled water that is laced with nicotine.

2.__Prohibition.__A person may not sell, offer for sale or possess nicotine water in this State.

3.__Violation; fine.__Any person who violates this section commits a civil violation for which the following fines may be imposed:

A.__For a first violation, $500;

B.__For a 2nd violation, $1,000; and

C.__For a 3rd or subsequent violation, $5,000.

Each sale or possession in violation of this section constitutes a separate violation for purposes of calculating the fine.

SUMMARY

This bill prohibits the sale or possession of water laced with nicotine in this State and establishes a fine of $500 for a first offense, $1,000 for a 2nd offense and $5,000 for a 3rd or subsequent offense.
