Sec. 1. Secretary of State to review model legislation. Resolved: That the
Secretary of State shall review the model legislation proposed by
the joint task force of the National Association of Secretaries
of State and the International Association of Commercial
Administrators to prevent fraudulent filings under the Uniform
Commercial Code against public officials or by individuals
attempting to file liens against themselves to try to avoid
taxes, judgments or other debt. Based on that review, the
Secretary of State shall submit an assessment of that model
legislation, together with any proposed implementing legislation,
to the joint standing committee of the Legislature having
jurisdiction over judiciary matters no later than January 15,
2005. Following receipt and review of the report, the joint
standing committee is authorized to report out a bill to the
First Regular Session of the 122nd Legislature.

 
SUMMARY

 
This resolve directs the Secretary of State to review model
legislation designed to prevent fraudulent filings under the
Uniform Commercial Code and submit recommendations to the joint
standing committee of the Legislature having jurisdiction over
judiciary matters.
