Sec. 1. 32 MRSA §13796 is enacted to read:

§13796.__Refills requested by professional nursing service

A pharmacist may refill a prescription for a nonnarcotic drug up to one week prior to the end of the prescription when the refill is requested by a registered professional nurse providing nursing services in a home setting.__By October 1, 2004, the board shall adopt rules to implement this section.__Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

SUMMARY

This bill proposes to allow pharmacists to refill a prescription for a nonnarcotic drug up to a week prior to the end of the prescription if the refill is ordered by a registered professional nurse providing nursing services in a home setting. The bill proposes to direct the Maine Board of Pharmacy to adopt routine technical rules to implement the section.
