Item 1

Emergency preamble. Whereas, Acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

Whereas, waiting for the 90-day period to elapse would cause
undue delay in the appointment of the Executive Director of the
Workers' Compensation Board and the realignment of the board to
enable a simple majority of the board to make decisions; and

Whereas, it would be detrimental to claimants and employers and
would waste state resources to perpetuate unnecessarily an
inefficient, and often deadlocked, administrative structure; and

Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 2 MRSA §6, sub-§1, as amended by PL 2003, c. 469, Pt. A, §1,
