A.__"Crisis residential services" means services provided to
persons in acute psychiatric crisis in short-term, highly
supportive and supervised residential settings.__"Crisis
residential services" includes monitoring of behavior,
therapeutic intervention, supportive counseling,
coordination with other community-based services and
supervision to ensure personal safety.

 
B.__"Crisis services" means those personal supervision
services and therapeutic supports provided during a
psychiatric emergency that include monitoring of behavior
and response to therapeutic interventions, participation in
and assistance during crisis and post-crisis stabilization
activities and supervision to ensure personal safety.__
Crisis services may be provided in the insured's home or
outside of the home.

 
2.__Required coverage.__A carrier shall provide coverage for
crisis services and crisis residential services in all health
plans to meet adequately the medical needs of the enrollee.__A
carrier may require that crisis services and crisis residential
services be rendered by an organization that is licensed as a
crisis services or crisis residential services provider by the
Department of Behavioral and Developmental Services.

 
3.__Exceptions.__This section does not apply to policies,
contracts or certificates covering employees of employers with 20
or fewer employees, whether the group policy is issued to the
employer, to an association, to a multiple-employer trust or to
another entity.

 
4.__Application.__Except as__noted in subsection 3, the
requirements of this section apply to all group policies,
contracts and certificates executed, delivered, issued for
delivery, continued or renewed in this State.__For purposes of
this section, all contracts are deemed to be renewed no later
than the next yearly anniversary of the contract date.

 
Sec. FF-2. Application. This Part applies to policies, contracts and
certificates executed, delivered, issued for delivery, continued
or renewed in this State on or after April 1, 2004. For purposes
of this Part, all contracts are deemed to be renewed no later
than the next yearly anniversary of the contract date.

 
Sec. FF-3. Exemption from review. Notwithstanding the Maine Revised
Statutes, Title 24-A, section 2752, this Part must be enacted
without review and evaluation by the Department of Professional
and Financial Regulation, Bureau of Insurance.
