Sec. 251. 12 MRSA §12502, sub-§2, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, is repealed and the following enacted in its place:

2.__Penalties.__The following penalties apply to violations of this section.

A.__A person who violates the terms of a special privilege under this section commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates the terms of a special privilege under this section after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Each day a person violates the terms of a special privilege under this section is a separate offense.

Sec. 252. 12 MRSA §12503, sub-§§2, 3, 4, 5 and 6, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, are amended to read:

2. Land used for agricultural purposes; domicile. Notwithstanding section 10606 as it applies to this subchapter, any Any resident and any member of the resident's immediate family, as long as the angler's license to fish is not under suspension or revocation, may fish without a license in open inland waters from land:

A. To which they are legally entitled to possession;

B. On which they are actually domiciled; and

C. That is used exclusively for agricultural purposes.

3. Free fishing days. The Saturday and Sunday of Father's Day weekend and the Saturday and Sunday immediately preceding President's Day are free fishing days. Notwithstanding sections 10606 and section 12501, it is lawful during a free fishing day established under this subsection for a person to fish without a license in inland waters, except that this subsection does not
