| A. Each day a person violates the terms of the special | privilege granted under this subsection that person commits | a civil violation for which a forfeiture of not less than | $100 and not more than $500 may be adjudged. |
|
| B. An inpatient at the Veterans Administration Hospital at | Togus permitted under this subsection: |
|
| (1)__May not fish beyond a 25-mile radius of Togus; and |
|
| (2)__Shall have supervision while fishing or have in | that inpatient's possession a valid pass issued by the | hospital. |
|
| C. The following penalties apply to violations of this | subsection. |
|
| (1)__A person who violates paragraph B commits a civil | violation for which a fine of not less than $100 nor | more than $500 may be adjudged. |
|
| (2)__A person who violates paragraph B after having | been adjudicated as having committed 3 or more civil | violations under this Part within the previous 5-year | period commits a Class E crime. |
|
| Each day a person violates paragraph B is a separate | offense. |
|
| | 6. Fishing during event sanctioned by department. | Notwithstanding section 10606 as it applies to this subchapter, a | A person who does not hold a fishing license may assist a child | or a handicapped person who is a participant in a fishing event | sanctioned by the department. |

| | Sec. 253. 12 MRSA §12504, sub-§3-A is enacted to read: |
|
| | 3-A. Violation of rules; penalty.__Except as provided in | section 12602, the following penalties apply to violations of | rules adopted under this section. |
|
| A.__A person who violates a rule adopted under subsection 3 | commits a civil violation for which a fine of not less than | $100 nor more than $500 may be adjudged. |
|
| B.__A person who violates a rule adopted under subsection 3 | after having been adjudicated as having committed 3 or more | civil violations under this Part within the previous 5-year | period commits a Class E crime. |
