2. Crime.__A person who violates a rule regulating open-water
fishing or ice fishing, except a rule implementing a statute the
violation of which is a Class E crime, after having been
adjudicated as having committed 3 or more civil violations under
this Part within the previous 5-year period commits a Class E
crime.

 
Sec. 268. 12 MRSA §12603, sub-§2, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is repealed and the following
enacted in its place:

 
2.__Penalty.__The following penalties apply to violations of
this section.

 
A.__A person who violates subsection 1 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B.__A person who violates subsection 1 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
Sec. 269. 12 MRSA §12605, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed.

 
Sec. 270. 12 MRSA §12608, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed and the following enacted
in its place:

 
§12608.__Failure to label fish

 
1.__Prohibition.__A person may not keep the following species
of fish at any sporting camp, hotel or public lodging place
unless the name and address of the person who caught the fish is
attached to the fish:

 
A.__Black bass;

 
B.__Salmon;

 
C.__Togue; or

 
D.__Trout.

 
2.__Penalty.__The following penalties apply to violations of
this section.
