| | 2. Criminal violation.__A person who violates a rule | regulating scientific collection permits after having been | adjudicated as having committed 3 or more civil violations under | this Part within the previous 5-year period commits a Class E | crime. |

| §12707. Unlawful activity in wildlife sanctuary; |

| general prohibitions and exceptions |

| | Except to the extent permitted by the commissioner under | section 12701, activities listed in this section are prohibited | in a wildlife sanctuary. |

| | 1. Unlawful activity in wildlife sanctuary. Except as | provided in subsection 2, a person may not: |
|
| A. Trap or hunt any wild animal or wild bird at any time | within a wildlife sanctuary as designated in section 12706; | or |
|
| B. Possess any wild animal or wild bird taken in violation | of paragraph A. |
|
| | 1-A.__Unlawful activity in wildlife sanctuary.__Except as | provided in subsection 2, the following activities are | prohibited. |
|
| A.__A person may not trap or hunt any wild animal or wild | bird at any time within a wildlife sanctuary as designated | in section 12706. |
|
| (1)__A person who violates this paragraph commits a | civil violation for which a fine of not less than $100 | nor more than $500 may be adjudged. |
