B.__Leave open a gate or bars on another person's land; or

C.__Trample or destroy crops on another person's land.

A person who violates this subsection commits a Class E crime.

23.__Operating ATV on cropland or pastureland.__A person may not operate an ATV on any cropland or pastureland without the permission of the owner or lessee.__As used in this subsection, "cropland" means acreage in tillage rotation, land being cropped and land in bush fruits, and "pastureland" means acreage devoted to the production of forage plants used for animal production.

A.__A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Sec. 417. 12 MRSA §13158, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, is repealed.

Sec. 418. 12 MRSA §13158-A is enacted to read:

§13158-A.__Unlawfully permitting operation; liability

for damage by other persons

1.__ATV owner; operation by another.__A person is in violation of this subsection if that person is the owner of an ATV that is operated in violation of this chapter.

A.__A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.
