3. Penalties. A person who violates subsection 1 this section commits a Class E crime for which the court shall impose a fine of not less than $500, none of which may be suspended. The court also shall impose a fine of $500 for each turkey unlawfully killed, none of which may be suspended.

Sec. 189. 12 MRSA §11851, sub-§3 is enacted to read:

3.__Penalty.__A person who violates this section commits a Class E crime.

Sec. 190. 12 MRSA §§11853 and 11855, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, are repealed and the following enacted in their place:

§11853.__Closed season; Haley Pond

1.__Prohibition.__A person may not hunt waterfowl on Haley Pond in the Town of Rangeley and Dallas Plantation in the County of Franklin.

2. Penalties.__The following penalties apply to violations of this section.

A.__A person who violates subsection 1 commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates subsection 1 after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

§11855.__Unlawful use of migratory game birds

1. Prohibition.__Unless specifically permitted by regulations of the federal Migratory Bird Treaty Act, 16 United States Code, Sections 703 to 712, or by rules adopted by the commissioner in conformity with Title 5, Part 18, except section 8052, subsection 3 of that Title, a person may not:

A.__Hunt migratory game birds;

B.__Possess migratory game birds;
