| | 3. Carrying a firearm while trapping. Notwithstanding | section 11205, subsection 1, paragraph A and section 11206 11206- | A, subsection 1, paragraphs paragraph A and B, a person who holds | a valid trapping license may carry a firearm at any time during | the open trapping season for the sole purpose of dispatching | trapped animals. |

| | Sec. 223. 12 MRSA §12257, as enacted by PL 2003, c. 414, Pt. A, §2 | and affected by Pt. D, §7, is repealed and the following enacted | in its place: |

| | 1. Prohibition.__A department biologist or warden may not trap | wild animals for profit while on duty within the district to | which that person is assigned. |

| | 2. Penalties.__The following penalties apply to violations of | this section. |

| A.__A person who violates subsection 1 commits a civil | violation for which a fine of not less than $100 nor more | than $500 may be adjudged. |
|
| B.__A person who violates subsection 1 after having been | adjudicated as having committed 3 or more civil violations | under this Part within the previous 5-year period commits a | Class E crime. |

| | Sec. 224. 12 MRSA §12258, sub-§2, as enacted by PL 2003, c. 414, Pt. | A, §2 and affected by Pt. D, §7, is amended to read: |

| | 2. Restrictions. A licensed trapper with an who holds a valid | eel permit may for purposes of baiting traps take eels by eel | pots or hook and line.__A person harvesting eels under this | subsection may not use any means other than eel pots or hook and | line to take eels and may not take more than 20 pounds of eels | annually, by eel pots or hook and line only, for use in baiting | traps. |
