2. Failure to remove animal from trap. A person may not fail
to shall remove or cause to be removed from that person's trap an
animal found caught in that trap.

 
A person who violates this subsection commits a Class E crime.

 
3. Carrying a firearm while trapping. Notwithstanding
section 11205, subsection 1, paragraph A and section 11206 11206-
A, subsection 1, paragraphs paragraph A and B, a person who holds
a valid trapping license may carry a firearm at any time during
the open trapping season for the sole purpose of dispatching
trapped animals.

 
Sec. 223. 12 MRSA §12257, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed and the following enacted
in its place:

 
§12257.__Trapping by certain department employees

 
1. Prohibition.__A department biologist or warden may not trap
wild animals for profit while on duty within the district to
which that person is assigned.

 
2. Penalties.__The following penalties apply to violations of
this section.

 
A.__A person who violates subsection 1 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B.__A person who violates subsection 1 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
Sec. 224. 12 MRSA §12258, sub-§2, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is amended to read:

 
2. Restrictions. A licensed trapper with an who holds a valid
eel permit may for purposes of baiting traps take eels by eel
pots or hook and line.__A person harvesting eels under this
subsection may not use any means other than eel pots or hook and
line to take eels and may not take more than 20 pounds of eels
annually, by eel pots or hook and line only, for use in baiting
traps.

 
Sec. 225. 12 MRSA §12258, sub-§3, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is repealed and the following
enacted in its place:
