Preamble. The Constitution of Maine, Article IX, Section 23
requires that real estate held by the State for conservation or
recreation purposes may not be reduced or its uses substantially
altered except on the vote of 2/3 of all members elected to each
House.

 
Sec. 1. Director of Bureau of Parks and Lands authorized to transfer management
responsibility for certain land in Fort Knox State Park to Department of Transportation.
Resolved: That the Director of the Bureau of Parks and Lands
within the Department of Conservation may by financial order
transfer management responsibility of the following described
property to the Department of Transportation for the purposes of:
construction and maintenance of the westerly approach and
abutment of the new bridge replacing the Waldo-Hancock Bridge;
and confirmation of control, management and supervision of the
portion of State Route 174 that crosses Fort Knox State Park and
a portion of U.S. Route 1 that leads to the westerly approach to
the existing Waldo-Hancock Bridge. The property is more
particularly described as follows:

 
A portion of the Fort Knox State Historic Site, situated in
the Town of Prospect, County of Waldo, and State of Maine,
containing a total of 5.37 acres, as shown on a plan
entitled, "State of Maine Department of Transportation Right
of Way Map, State Highway '251' (Route 174) Prospect-Verona
P.I.N. 007965.40," Sheets 3, 4 and 5 of 7 sheets, dated
January 2004, D.O.T. File No. 14-77, to be recorded in the
Waldo and Hancock Registries of Deeds, and on file at the
Department of Transportation, 16 State House Station,
Augusta, Maine.

Sec. 2. No funds may be exchanged. Resolved: That no funds may be
exchanged between the Department of Transportation and the
Department of Conservation for the transfer of management
responsibility described in section 1.

 
SUMMARY

 
This resolve authorizes the transfer of management
responsibility for a small portion of Fort Knox State Historic
Site by the Director of the Bureau of Parks and Lands within the
Department of Conservation to the Department of Transportation
for the purpose of constructing and maintaining a portion of the
Waldo-Hancock Bridge replacement and confirming that portions of
State Route 174 and U.S. Route 1 have been constructed, occupied
and maintained for highway purposes. The area subject to this
transfer of management responsibility is approximately 5 acres,
