| | Emergency preamble. Whereas, Acts of the Legislature do not become | effective until 90 days after adjournment unless enacted as | emergencies; and |

| | Whereas, the Maine Revised Statutes, Title 5, section 8060 | requires each agency with rule-making authority to file an annual | regulatory agenda within 100 days after adjournment of a regular | legislative session; and |
|
| | Whereas, the last regulatory agenda issued by state agencies | covers the period from October 1, 2003 to October 1, 2004; and |
|
| | Whereas, the Second Regular Session of the 121st Legislature | adjourned on January 30, 2004, establishing May 10, 2004 as the | deadline for state agencies to file a regulatory agenda for the | coming year, which would create confusion due to an overlap in | the time period for filing the 2003-04 regulatory agenda and the | 2004-05 regulatory agenda; and |

| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, |

| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 5 MRSA §8060, sub-§2, as amended by PL 1993, c. 362, §7, is | further amended to read: |
|
| | 2. Due date. A regulatory agenda must be issued between the | beginning of a regular legislative session and 100 days after | adjournment by October 1st of each year. |
|
| | Emergency clause. In view of the emergency cited in the preamble, | this Act takes effect when approved. |
|
| | This bill changes the deadline for state agencies to file an | annual regulatory agenda to a date certain of October 1st instead | of the current deadline of 100 days after the end of a regular | legislative session. |
