| | A person may not intentionally kill, injure or molest a wild | animal or wild bird with a motor vehicle, motorboat or aircraft. |

| | A person who violates this section commits a Class E crime. |

| | 1.__Prohibition on use of aircraft to hunt.__A person on the | ground or airborne may not use an aircraft to aid or assist in | hunting: |

| A.__A person who violates subsection 1 without the taking of | a bear, deer or moose commits a civil violation for which a | forfeiture of not less than $100 nor more than $500 may be | adjudged, unless otherwise specified. |

| B.__A person who violates subsection 1 and takes a bear, | deer or moose commits a Class E crime for which the court |
