(1)__The demarcation of the areas with the shortened season
follows recognizable physical boundaries, such as
rivers and railroad rights-of-way;

 
(2)__The determination is made and published prior to June
1st of any year; and

 
(3)__The Saturday preceding the first day of open season on
deer is an open day for residents of the State only.

 
C.__The commissioner may terminate the open season on deer
at any time in any area if, in the commissioner's opinion,
an immediate emergency action is necessary due to adverse
weather conditions or severe hunting pressure.

 
D.__Whenever a section of the State is closed to hunting by
proclamation of the Governor during the open season on deer,
the commissioner, after the proclamation has been annulled,
with the consent of the Governor, may extend the open season
for deer hunting in that section of the State for a period
not to exceed the number of days lost.

 
§11402.__Special regulations

 
1.__Vinalhaven; open season.__There is an open season on deer
in the Town of Vinalhaven, and the islands within the confines of
the Town of Vinalhaven, to conform with the open season on deer
for Knox County.

 
2.__Southport; open season.__There is an open season on deer
in the Town of Southport, and the islands within the confines of
the Town of Southport, to conform with the open season on deer in
Lincoln County.

 
3.__Closed season.__Except as provided by rule pursuant to
subsection 4, there is a continual closed season on deer in the
following places:

 
A.__Mount Desert Island;

 
B.__Cross Island in Washington County;

 
C.__Scotch Island in Washington County;

 
D.__The Town of Isle au Haut and the islands within the
confines of the Town of Isle au Haut in Knox County;

 
E.__All of Swans Island in the Town of Swan's Island in
Hancock County;
