| (2)__After the owner or keeper of the dog has received | written notice that the dog has committed any act | prohibited by paragraphs E and F, anyone may kill the | dog when it is found committing any of those prohibited | acts. |

| D.__A person having evidence of a dog chasing, killing, | wounding or pursuing a moose, caribou, deer or elk or any | other wild animal in closed season, or of a dog kept and | used for that purpose, or of a dog worrying, wounding or | killing a domestic animal, including another dog, or | livestock, poultry, fowl or fur-bearing animal legally in | captivity, when the dog is outside of the enclosure or | immediate care of the dog's owner or keeper, may present | that evidence to the District Court having jurisdiction. |

| (1)__The court may issue a warrant against the owner of the | dog, ordering the owner to show cause why the dog | should not be killed. |
|
| (2)__Upon hearing the evidence in the case, the court may | order the dog killed by a game warden. |
|
| (3)__The costs of prosecution must be paid by the owner or | keeper of the dog. |
|
| E.__Except as provided in paragraph F, the owner or keeper | of a dog commits a civil violation for which a forfeiture of | not less than $100 nor more than $500 may be adjudged if: |
|
| (1)__That owner's or keeper's bird dog, retrieving dog | or hound dog is found killing or wounding a moose, | caribou, deer or elk during a period in which it is | lawful to train dogs, as provided for in section 12051, | subsection 1, while the dog is at a licensed dog | training area or at a licensed trial for retrieving | dogs; or |

| (2)__That owner or keeper has been notified under | paragraph C and that owner or keeper permits any dog | mentioned in the notice to leave the owner's or | keeper's immediate control. |
|
| F.__The owner or keeper of a dog commits a civil violation | for which a forfeiture of not less than $500 nor more than | $1,000, none of which may be suspended, may be adjudged if | that owner's or keeper's dog is found: |
