§12511.__Permit to introduce fish or fish spawn into private |

| | The commissioner may issue a written permit to introduce fish | or fish spawn into a private pond. |

| §12512. Permit to transport live fish for breeding |
|
| | The commissioner may issue a permit to a person permitting | that person to take and transport within the limits of the State | fish taken in the State for breeding or advertising purposes. |

| §12513. Permit to take baitfish |
|
| | Whenever inland waters are closed to fishing, the commissioner | may issue permits to take baitfish for bait purposes from those | waters. |

| §12551. Dealing in live smelts and baitfish |
|
| | 1.__Definition.__For purposes of this section, "business | facility" means a fixed place of business and does not include a | motor vehicle or trailer.__Live smelts or baitfish that are held | in or on a motor vehicle or trailer by a person licensed under | this section are considered in transport even if the motor | vehicle or trailer may be temporarily placed at a specific | location by the licensee, or the licensee's designee, for the | purpose of selling live smelts and baitfish to anglers. |

| | 2.__License required.__Except as otherwise authorized pursuant | to this Part, a person may not engage in any activity, for which | a license may be issued under this section without a valid | license issued under this section. |

| Each day a person violates this subsection, that person commits a | Class E crime for which a minimum fine of $50 and an amount equal | to twice the applicable license fee must be imposed. |

| | 3.__Eligibility.__A resident or nonresident is eligible to | obtain a license to deal in live smelts and baitfish upon payment | of the appropriate fee. |
