(2)__Operate an ATV across the tracks of a railroad after
having been forbidden to do so by the railroad owning the
railroad right-of-way or by an agent of that railroad,
either personally or by appropriate notices posted
conspicuously along the railroad right-of-way.

 
B.__Notwithstanding paragraph A, a person may operate within
the right-of-way of a portion of railroad line that has been
officially abandoned under the authority of the Interstate
Commerce Commission.

 
A person who violates this subsection commits a civil violation
for which a forfeiture of not less than $100 nor more than $500
may be adjudged.

 
19.__Operating too close to certain buildings.__A person may
not operate an ATV within 200 feet of a dwelling, hospital,
nursing home, convalescent home or church, except a person may:

 
A.__Operate an ATV on public ways in accordance with
subsections 3, 6, 7, 8 and 9;

 
B.__Operate an ATV on the frozen surface of any body of
water; and

 
C.__Operate an ATV on land that the operator owns or is
permitted to use.

 
A person who violates this subsection commits a civil violation
for which a forfeiture of not less than $100 nor more than $500
may be adjudged.

 
20.__Failure to report accident.__The operator of an ATV
involved in an accident resulting in injuries requiring the
services of a physician or in the death of a person, a person
acting for such an operator or the owner of the involved ATV
having knowledge of the accident if the operator of the ATV is
unknown shall give notice of the accident, by the quickest means
of communication, to a law enforcement officer available nearest
to the place where the accident occurred.

 
Accidents involving only property damage to the estimated amount
of $1,000 or more must be reported within 72 hours on forms
provided by the department.

 
A person who fails to comply with this subsection commits a civil
violation for which a forfeiture of not less than $100 nor more
than $500 may be adjudged.
