Each day a A person who violates this subsection, that person
commits a Class E crime for which a minimum fine of $50 and an
amount equal to twice the applicable license fee must be imposed,
except that, notwithstanding Title 17-A, section 1301, the fine
may not be less than $1,000 nor more than $10,000.

 
Sec. B-257. 12 MRSA §§12511 and 12512, as enacted by PL 2003, c. 414,
Pt. A, §2 and affected by Pt. D, §7, are repealed and the
following enacted in their place:

 
§12511.__Permit to introduce fish or fish spawn into

 
private pond

 
1.__Permit required.__Except as otherwise authorized pursuant
to this Part, a person may not introduce fish or fish spawn into
a private pond without a valid permit issued under this section.__
A person who violates this subsection commits a Class E crime,
except that, notwithstanding Title 17-A, section 1301, the fine
may not be less than $1,000 nor more than $10,000.

 
2.__Issuance. The commissioner may issue a written permit to
introduce fish or fish spawn into a private pond.

 
§12512.__Permit to transport live fish for breeding

 
and advertising

 
1.__Permit required.__Except as otherwise authorized pursuant
to this Part, a person may not take and transport within the
limits of the State fish taken in the State for breeding or
advertising purposes without a valid permit issued under this
section.__A person who violates this subsection commits a Class E
crime, except that, notwithstanding Title 17-A, section 1301, the
fine may not be less than $1,000 nor more than $10,000.

 
2. Issuance.__The commissioner may issue a permit to a person
permitting that person to take and transport within the limits of
the State fish taken in the State for breeding or advertising
purposes.

 
Sec. B-258. 12 MRSA §12551, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed.

 
Sec. B-259. 12 MRSA §12551-A is enacted to read:

 
§12551-A. Dealing in live smelts and baitfish

 
1.__Definition.__For purposes of this section, "business
facility" means a fixed place of business and does not include a
motor vehicle or trailer.__Live smelts or baitfish that are held
in or
on a motor vehicle or trailer by a person licensed under
