the propagation or survival of an endangered or threatened | species; and |

Under such terms and conditions as the commissioner may | prescribe, permit any endangered or threatened species that | enters the State and is being transported to a point outside | the State to be so entered and transported without | restriction in accordance with the terms of any federal or | state permit. |

| | Sec. B-315. 12 MRSA §12852, as enacted by PL 2003, c. 414, Pt. A, §2 | and affected by Pt. D, §7, is repealed and the following enacted | in its place: |

| §12852.__Rule violations; licensed guides and trip leaders |
|
| | The following penalties apply to violations of rules | regulating licensed guides or camp leaders and course instructor | certificates. |
|
| | 1.__Civil.__Notwithstanding section 10650, a person who | violates a rule regulating licensed guides or camp trip leaders | and course instructor certificates commits a civil violation for | which a fine of not less than $100 nor more than $500 may be | adjudged. |
|
| | 2. Criminal.__A person who violates a rule regulating licensed | guides or camp trip leaders and course instructor certificates | after having been adjudicated as having committed 3 or more civil | violations under this Part within the previous 5-year period | commits a Class E crime. |
