this Part within the previous 5-year period commits a

(3)__If the violation committed by the client is a
criminal violation, a__person licensed as a guide who
violates this paragraph commits a Class E crime.

 
B.__A person licensed as a guide who has knowledge that a
client has violated the provisions of this Part shall,
within 24 hours, inform a person authorized to enforce this
Part.

 
(1)__A person who violates this paragraph commits a
civil violation for which a fine of not less than $100
nor more than $500 may be adjudged.

 
(2)__A person who violates this paragraph after having
been adjudicated as having committed 3 or more civil
violations under this Part within the previous 5-year
period commits a Class E crime.

 
C.__A person licensed as a guide may not take a party of
more than 12 people out on any lake, stream or waterway in
the State at any time.

 
(1)__A person who violates this paragraph commits a
civil violation for which a fine of not less than $100
nor more than $500 may be adjudged.

 
(2)__A person who violates this paragraph after having
been adjudicated as having committed 3 or more civil
violations under this Part within the previous 5-year
period commits a Class E crime.

 
Sec. B-319. 12 MRSA §12860, sub-§1-A is enacted to read:

 
1-A.__Prohibition.__A person may not conduct trip camping
under subsection 1 without a trip leader permit issued under this
section. Each day a person violates this subsection, that person
commits a Class E crime for which a minimum fine of $50 and an
amount equal to twice the applicable license fee must be imposed.

 
Sec. B-320. 12 MRSA §12901, sub-§2, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is amended to read:

 
2. Affiliated outfitter. "Affiliated outfitter" means:

 
A. An outfitter who owns directly, indirectly or through a
chain of successive ownership 10% or more of the financial
interest in any other outfitter;
