Rules adopted pursuant to this section are routine technical
rules as defined in Title 5, chapter 375, subchapter 2-A.

 
Sec. B-413. 12 MRSA §13157, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed.

 
Sec. B-414. 12 MRSA §13157-A is enacted to read:

 
§13157-A.__Operation of ATVs

 
1.__No permission given. This chapter does not give license or
permission to cross or go on the property of another.

 
2.__Stop and identify requirement.__Persons operating ATVs
upon the land of another shall stop and identify themselves upon
the request of the landowner or the landowner's duly authorized
representative.__A person who violates this subsection commits a
Class E crime.

 
3.__Operating ATV upon controlled access highway.__The
following provisions govern the operation of ATVs on controlled
access highways.

 
A.__A person may not operate an ATV upon a controlled access
highway or within the right-of-way limits of a controlled
access highway, except that:

 
(1)__A properly registered ATV may cross controlled
access highways by use of bridges over or roads under
those highways or by use of roads crossing controlled
access highways at grade; and

 
(2)__The Commissioner of Transportation may issue
special permits for designated crossings of controlled
access highways.

 
B.__The following penalties apply to violations of this
subsection.

 
(1)__A person who violates this subsection commits a
civil violation for which a fine of not less than $100
nor more than $500 may be adjudged.

 
(2)__A person who violates this subsection after having
been adjudicated as having committed 3 or more civil
violations under this Part within the previous 5-year
period commits a Class E crime.
