This bill includes General Fund appropriations of $2,655,340 in fiscal year 2004-05 to the Department of Corrections to provide funding for additional beds at the department's correctional facilities as well as funding for the County Jail Prisoner Support and Community Corrections Fund.  The additional costs associated with directing the Department of Behavioral and Developmental Services and the Department of Corrections to develop a joint plan of action to address mental illness in the criminal justice community can be absorbed by the above mentioned agencies utilizing existing  budgeted resources.  The additional costs to the Judicial Department for making adjustments to their computer system and dealing with additional filings can also be absorbed.
Legislative Study
The Legislature will require $840 in fiscal year 2003-04 and $2,520 in fiscal year 2004-05 to cover the projected legislative costs to extend the life of the Commission To Improve the Sentencing, Supervision, Management and Incarceration of Prisoners.  The Legislature has budgeted  $20,000 in fiscal year 2004-05 for legislative studies.  Whether that amount is sufficient to fund all studies, including the fiscal year 2004-05 legislative costs of this bill, will depend on the number of studies authorized by the Legislative Council and the Legislature.  Other expenses attributable to the extension may be paid from the remaining balance of the original appropriation to the Department of Corrections for the Commission.  If the legislative costs are also to be paid from those funds the bill should be amended to add language allowing transfers to the Legislature for the per diem and expenses of legislative members of the Commission.
