Sec. 1. 29-A MRSA §2083, sub-§1, as enacted by PL 1993, c. 683, Pt. A, §2 and affected by Pt. B, §5, is repealed and the following enacted in its place:

1.__Requirement.__Every person who operates a motorcycle, motor-driven cycle or moped, whether on or off the highways, shall wear protective headgear.__Every person who rides as a passenger on a motorcycle, motor-driven cycle or moped or in a sidecar attached to a motorcycle or motor-driven cycle, whether on or off the highways, shall wear protective headgear.

Sec. 2. 29-A MRSA §2083, sub-§2, as enacted by PL 1993, c. 683, Pt. A, §2 and affected by Pt. B, §5, is amended to read:

2. Compliance. An operator of a motorcycle or motor-driven cycle, parent or guardian may not allow a passenger under the age of 15 years to ride in violation of this section.

SUMMARY

This bill requires use of helmets by all operators and passengers of motorcycles, motor-driven cycles and mopeds.
