Sec. 1. 5 MRSA §7, as amended by PL 1977, c. 376, §1, is further amended by inserting after the 2nd indented paragraph a new indented paragraph to read:

All state-owned motor vehicles that use diesel fuels must use biodiesel fuel.__The requirements of this paragraph are satisfied if the fuel used includes at least 20% biodiesel fuel.__For purposes of this paragraph, "biodiesel fuel" means a renewable fuel derived from vegetable oils or animal fats.

Sec. 2. 5 MRSA §1766-A is enacted to read:

§1766-A. Use of biodiesel fuel in state facilities

The Department of Administrative and Financial Services, through the Bureau of General Services, shall ensure that all facilities owned by the State that consume heating oil use biodiesel fuel.__The requirements of this section are satisfied if the fuel used includes at least 20% biodiesel fuel.

For purposes of this section, "facilities owned by the State" includes all facilities that are owned by the legislative, judicial or executive branch of government; any state department, agency or authority; the University of Maine System; and the Maine Community College System.__For purposes of this section, "biodiesel fuel" means a renewable fuel derived from vegetable oils or animal fats.

SUMMARY

This bill requires that all facilities owned by the State that consume heating oil use biodiesel fuel. This bill also requires state-owned motor vehicles that use diesel fuels to use biodiesel fuel. These requirements are satisfied if the fuel used includes at least 20% biodiesel fuel.
