| | Emergency preamble. Whereas, acts and resolves of the Legislature do | not become effective until 90 days after adjournment unless | enacted as emergencies; and |

| | Whereas, this resolve requires that the Department of Inland | Fisheries and Wildlife propose rules by July 1, 2005; |

| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, be it |

| | Sec. 1. Department review; development of recommendations. Resolved: That the | Department of Inland Fisheries and Wildlife shall review the | rules adopted to implement the laws governing brook trout fishing | and trout management. Specifically, the department shall: |
|
| | 1. Evaluate the effectiveness of the 4 categories of brook | trout fishing rules in achieving the goals in the trout | management plan; |
|
| | 2. Examine all of the special brook trout fishing rules on | bodies of water and evaluate whether they are necessary to | achieve the goals in the trout management plan; |
|
| | 3. Develop recommendations for any necessary changes in the 4 | categories of brook trout fishing rules; and |
|
| | 4. Develop recommendations to repeal any special brook trout | fishing rules that are not necessary to achieve the trout | management plan goals; and be it further |
|
| | Sec. 2. Rulemaking. Resolved: That no later than July 1, 2005, based | on the review and development of recommendations pursuant to | section 1, the Department of Inland Fisheries and Wildlife shall | propose rules to implement any necessary changes to the rules | implementing the laws governing brook trout fishing and trout | management. Rules adopted pursuant to this resolve are major | substantive rules as defined in the Maine Revised Statutes, Title | 5, chapter 375, subchapter 2-A. |

| | Emergency clause. In view of the emergency cited in the preamble, | this resolve takes effect when approved. |
