Sec. 1. 11 MRSA §2-315-A is enacted to read:

§2-315-A.__Implied warranty disclosure

When a seller of goods offers a buyer a service contract or promises services for a fee, the seller must provide information on the buyer's implied warranty rights as described sections 2- 314 and 2-315.

Sec. 2. 11 MRSA §2-316, sub-§(5) ¶(a), as amended by PL 1997, c. 497, §1, is further amended to read:

(a) A violation of this section or section 2-314, 2-315 or 2-316 2-315-A arising from the retail sale of consumer goods and services constitutes a violation of Title 5, chapter 10, Unfair Trade Practices Act.

SUMMARY

This bill requires that, when a seller attempts to sell a service contract for a consumer good, the seller provide information to the buyer on the State's implied warranty law.
