| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 11 MRSA §2-315-A is enacted to read: |
|
| §2-315-A.__Implied warranty disclosure |
|
| | When a seller of goods offers a buyer a service contract or | promises services for a fee, the seller must provide information | on the buyer's implied warranty rights as described sections 2- | 314 and 2-315. |
|
| | Sec. 2. 11 MRSA §2-316, sub-§(5) ¶(a), as amended by PL 1997, c. 497, | §1, is further amended to read: |
|
| (a) A violation of this section or section 2-314, 2-315 or | 2-316 2-315-A arising from the retail sale of consumer goods | and services constitutes a violation of Title 5, chapter 10, | Unfair Trade Practices Act. |
|
| | This bill requires that, when a seller attempts to sell a | service contract for a consumer good, the seller provide | information to the buyer on the State's implied warranty law. |
