Sec. 1. MaineCare buy-in for workers with disabilities. Resolved: That the
Department of Health and Human Services shall amend the
eligibility rules to allow employed persons with disabilities to
purchase coverage under the MaineCare program beginning January
1, 2006. The amended rules must maintain the income eligibility
limit of 250% of the federal nonfarm income official poverty
level for earned and unearned income combined and must remove any
separate limitation on unearned income. Rules adopted pursuant
to this section are routine technical rules as defined in Title
5, chapter 375, subchapter 2-A.

 
SUMMARY

 
This resolve requires the Department of Health and Human
Services to amend the rules to allow workers with disabilities to
purchase coverage in the MaineCare program beginning January 1,
2006. The rules must maintain the current income eligibility
limits while removing separate limits on earned and unearned
income. This resolve designates the rules as routine technical
rules.
