Sec. 1. 10 MRSA §1313-C is enacted to read:

§1313-C.__Authorization of consumer required for disclosure of

consumer reports

Notwithstanding sections 1313-A and 1313-B, a consumer reporting agency may not furnish a consumer report or disclose any information relating to a consumer for any purpose without the authorization of the consumer if the consumer has presented the consumer reporting agency with a copy of a police report prepared by a law enforcement agency in investigation of the misuse of the consumer's identification in suspected violation of Title 17-A, section 905-A.

SUMMARY

This bill prohibits a consumer reporting agency from furnishing a consumer report or disclosing information about a consumer unless the consumer has authorized the disclosure if the consumer has given a copy of a police report to the consumer reporting agency that was prepared by a law enforcement agency in investigation of identity theft involving the consumer.
