Sec. 1. 12 MRSA §12510, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by c. 614, §9, is repealed and the following enacted in its place:

§12510.__Introduction of fish into inland waters

1.__Other state agencies.__Notwithstanding any other provisions of law, the commissioner may not authorize another state agency to introduce fish into the inland waters of this state.

2.__Prohibition.__Except as otherwise authorized pursuant to this Part, a person may not introduce fish of any kind into any inland waters of this State.

3.__Penalty.__A person who violates subsection 2 commits a Class E crime, except that, notwithstanding Title 17-A, section 1301, the fine may not be less than $1,000 nor more than $10,000.

SUMMARY

This bill prohibits the Commissioner of Inland Fisheries and Wildlife from authorizing another state agency to introduce fish into the inland waters of the State.
