| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 22 MRSA c. 270, as amended, is further amended by repealing | | the chapter headnote and enacting in its place the following: |

| | | Sec. 2. 22 MRSA §1672, as repealed and replaced by PL 1985, c. 737, | | Pt. A, §53, is repealed and the following enacted in its place: |

| | | §1672.__Public rest room facilities required |
|
| | | 1.__Shopping centers.__In any building or facility constructed | | specifically as a shopping center after September 19, 1985, there | | must be installed a minimum of 2 toilets for the use of the | | public.__There must be at least one separate toilet for each sex | | and the toilets provided must be clearly marked, maintained in a | | sanitary condition and in good repair.__Lavatory facilities must | | be located within or immediately adjacent to all toilet rooms or | | vestibules.__No charge may be imposed for their use. |

| | | 2.__Retail stores.__Except for a retail store in a shopping | | center under subsection 1, if a retail store of at least 500 | | square feet in area has a rest room facility, the retail store | | shall make that rest room facility available for public use. |

| | | This bill requires retail stores of 500 square feet to make | | toilet facilities, if existing, available for public use. |
