Whereas, many municipalities post weight restrictions on roads during the spring months; and

Whereas, spring is an important season for agricultural operations during which many supplies are delivered for the upcoming growing season; and

Whereas, many agricultural operations will be disadvantaged this spring if their suppliers are not exempted from municipal road postings; and

Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §2395, sub-§9 is enacted to read:

9.__Agricultural products.__A vehicle delivering supplies or products necessary for an agricultural operation is exempt from the provisions of this section.

Emergency clause. In view of the emergency cited in the preamble, this Act takes effect when approved.

SUMMARY

This bill exempts vehicles delivering supplies or products necessary for an agricultural operation from restrictions placed on roads concerning weight, speed, operation and equipment during certain periods of the year.
