| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 32 MRSA §1400, sub-§3, as amended by PL 2001, c. 169, §1, is | | further amended to read: |

| | | 3. Funeral establishment. "Funeral establishment" means | | every place or premises devoted to or used in the care and | | preparation for the funeral and burial of human remains or | | maintained for the convenience of the bereaved for viewing or | | other services in connection with the human remains or as the | | office or place for carrying on the profession of funeral | | service. A funeral establishment must contain a preparation room | | or embalming room, an adequate casket and vault selection room | | and a holding facility or proper room in which a rite or ceremony | | may be held. |

| | | Sec. 2. State Board of Funeral Service to adopt rules for satellite facilities. The | | Department of Professional and Financial Regulation, State Board | | of Funeral Service shall adopt rules to allow a funeral | | establishment licensed under the Maine Revised Statutes, Title | | 32, chapter 21, to open a satellite or branch facility that need | | not comply with the full requirements for licensure of a funeral | | establishment. The rules must provide that the satellite or | | branch facility is required to pay the full licensing fee for a | | funeral establishment under Title 32, chapter 21. Rules adopted | | pursuant to this section are routine technical rules as defined | | in Title 5, chapter 375, subchapter 2-A. |

| | | This bill amends the definition of "funeral establishment" to | | make the definition more specific and directs the State Board of | | Funeral Service to adopt rules for the creation of satellite or | | branch facilities of funeral establishments. |
