Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 12 MRSA §11403, sub-§3 is enacted to read:

 
3.__Duty to return to kill site; articulable suspicion.__A
person who participates in the special archery season or receives
authority to hunt under this section has a duty to return to the
kill site of deer taken by virtue of this license upon request by
a game warden under the following conditions.

 
A.__A game warden may inspect a kill site and the equipment
used to harvest deer in the special archery season within 48
hours after the animal has been tagged or harvested if the
game warden has an articulable suspicion of a violation of a
rule pertaining to the special archery season for deer.__If
requested, a person who has killed a deer shall take a game
warden back to the kill site, the site of carcass
evisceration or the blood or drag trail for purposes such
as, but not limited to, verification of the kill site or to
obtain ovaries or other biological samples left behind.

 
B.__If a person refuses any request of a game warden under
this subsection, the commissioner may suspend that person's
license authorizing deer hunting in the expanded special
archery season.__A refusal under this paragraph is a civil
violation for which no less than $100 may be adjudged.

 
SUMMARY

 
Under this bill, a person hunting during the special archery-
only deer hunting season has a duty to return to the kill site
upon request of a game warden and permit inspection of equipment
used to harvest the deer.
